summer ends but summer weather doesn't. the dry grass is a big concern for firefighters here. they have to maintain their summer time alert. >> reporter: when temperatures hover in the mid-90s, october isn't much different than august, it has brought a wave of small, manageable fires. >> activity has been summerlike. seeing fire starts occurring throughout the bay area. very much like we would see during the normal summer periods. >> reporter: it was a day to beat the heat and many people know that now is not the time to be over doing it. >> i have been trying to get back with my walking and i have to do it early in the morning. i am not able to do it in athe afternoons with the heat -- in the afternoons with the heat. >> keep an eye on the most

vulnerables. >> make sure baby -- vulnerables. >> make sure babies are not over dressed, check on the elderly. >> reporter: this heat wave came at a good time for the bay area. >> activity of having large, major fires in california has been low. all of our resources are available locally. >> reporter: that paid off today and means why you understand why cal fire plans to stay at summer time staffing levels. live, robert handa, ktvu channel 2 news. breaking news out of san mateo county, a school bus accident before 5:00 p.m. tonight on highway 17. officials say the bus collided with a van. only the driver was inside the bus at the time and there are serious injuries. one lane of highway 17 is

closed at this hour. we are working to get more information. more developing news in the central valley. 40 people were injured when a big rig collided with a amtrak train along the amtrak line. the big rig struck the train where the tracks cross kansas avenue. ktvu's kara cara liu has more -- cara liu has more. >> reporter: one of the victims heard screams and crying before the accident. a big rig slams into the train about 12:30 p.m. this afternoon. you could see the derailed training leaning. she was in a second car, she says she was returning home after visiting hayward. she says she wasn't seriously hurt but it was scary when the

train started tipping. >> you couldn't see anything. it was just all dusty and, you know, you are breathing in the dirt. people start coughing, screaming, crying. it was horrible. >> reporter: that train left oakland about 7:30 a.m. this morning. folks on other trains this afternoon say they got a call from amtrak telling them about the derailment and saying they would have to be bussed. >> i take amtrak all the time, this is the first time anything like this happened. it is unnerving. >> reporter: 40 people have been taken to the hospital. amtrak saying none of the injuries are life threatening and we learned this was the same spot of another accident in 2008, 30 people were hurt in that crash when a truck crashed into a train. live in oakland, cara liu, ktvu channel 2 news. we have new video showing

the judge i have a motion. >> he will be assessed to determine whether he is competent to stand trial. >> reporter: he faces 7 counts of murder and three counts of attempted murder at oikos university. the victims were former classmates and a receptionist. the doors at oikos university are locked down, the classroom is no longer used by the program. >> it is not easy. it will never be forgotten. just in the past. every time something happens we may have to talk. >> reporter: the students passing the examines have been low, they have been working to correct that and hope to expand

the program next year. many students may be called as students when the case goes to trial. >> they want to become lvns and they wantt to finish and go on. -- they want to finish and go on. >> reporter: he is due back in court november 19. reporting live, rob roth, ktvu channel 2 news. opening statement in the murder trial of a woman accused of killing a nursing student. authorities say giselle esteban was jealous of michelle le. prosecutors say that drove giselle esteban to plan michelle le's murder. the defense argues it was a crime of passion. michelle le's family was at the courthouse today and their focus is the same. >> we are here for michelle. trying to be strong for her. >> investigators say giselle esteban killed michelle le in a garage in may of last year. today police said they have

determined that a shooting on the freeway yesterday was a targeted shooting. this red car was fired at after 3:30 p.m. while driving on highway 101. the three people inside the car were injured but are recovering. the incident snarled traffic for hours. now police say it was not a random shooting but they are still trying to determine the motive. police say a teacher accused of having a relationship with a former student was found dead this morning. james izumizaki was arrested last week but charges were never filed. the death is now being investigated as a suicide. the body was found this morning inside his car. james izumizaki had worked at albany middle school since 2008. officials say counselors will

be on campus. it is like something out of a spy movie, hackers used the school district's computer system to gain information about the government. officials say they did not compromise personal information. the hackers were using several innocent party's servers to try to steal information from the fbi and the cia. >> we have been told our firewall wasn't breached, they got to our server, used it to cover their tracks. >> since there was no breach they were asked to leave the server up and running to try to track down the guilty party. police arrested a man suspected of committing two bank robberies. adam kiedrowski was taken into custody tuesday. investigators believe he is the suspect who robbed a u.s. bank

on august 28 and another u.s. bank on september 5. illegal immigrants signed up for a program allowing them to apply for driver's license. >> hard to work my schedule around that and having my driver's license would be great. >> counselors helped dozens with their paper work. it is part of a bill signed by governor jerry brown yesterday. to qualify they must be under 30, going to school or graduated or served in the military. those who work in the community say culture differences may make it tough for those who are eligible. >> they are cautious with it comes to -- cautious when it comes to providing information to the government and it is something we tried to assist

were not wearing life vests. the fire that gutted his law office is the latest in a string of attacks against him. they confirmed the fire was intentionally set. the case is being treated as a act of domestic terrorism. the mayor says this isn't the first time he has been targeted. >> i have had written threats. verbal threats. telephone threats but none to the level of this type. >> the mayor says he believes the attacks are politically motivated. he is not fearful for his life but is concerned for his family. investigators arrested a woman in connection with a car fire over the weekend. firefighters found the vehicle

on fire saturday afternoon. police said today they arrested a woman on felony arson charges. two people were hurt today when a car slammed into a restaurant. happened this afternoon. the car crashed right into the front of the restaurant, smashing out a window. witnesses say the injuries do not appear to be serious. authorities haven't said what caused the crash. a controversial proposed study off the coast has environmentest angry and worried. ktvu's health and science editor john fowler is here where pg&e's plan is creating a lot of concern for marine mammals. >> reporter: 40-mile stretch of the ocean. from here down to south of pismo beach. beginning next month 12 days of

blasting the water here, every 15 seconds with super loud sound. >> reporter: the power plant could be at risk from undersea earthquake faults. >> the state called for the study and we are committed with working with them. >> reporter: penetrate the ocean floor, echoes reveal faults but it could also hurt marine mammals. >> we will have safe protection zones. >> reporter: there will be only temporary effects on marine life but i obtained this report, there would be significant and unavoidable harm to hundreds of marine mammals. >> we have seen beachings of marine mammals around the world following large noises. they say the state used better and more recent science

week. dry and drown out there. one thing i picked up earlier on the 5:00 p.m. news, fairfield, the winds out of the east, off shore. in the last hour they shifted southwest. that is the mechanism for the cooling. that is why we are calling for cooling tomorrow. it will still be hot tomorrow, upper 90s but we should see cooling around the bay. by tomorrow night, we will see a strong onshore push. we are lucky there isn't wind today or tomorrow because it is hot and dry. nasty fire conditions. if there was wind, the national weather service guys would have it up in no time a red flag warning. tomorrow's highs. 90s. purples are 100s. tomorrow still hot. you see the fog up to the coast

there. highs tomorrow will be cooler than these. not so much inland. around the bay, redwood city, san francisco, they will come down a few degrees. it is not going to be 90 degrees. as we go through time, go through this week, the middle of the weekend, the marine layer gets fat, fogchise in, cool -- fog comes in, cools us off. wednesday and thursday. look forward to that cooling and hopefully we get through it without fire issues. no spare the air day tomorrow. but air quality, in some places, will be not what you want. wouldn't be a bad idea to carpool. 99 antioch. 99 bread wood -- brentwood. 96 in morgan hill. 97 gilroy. along the coast, really,
